Terms of Service (ToS) – CraftingHosting Free & Premium Hosting

§1 Scope and Subject Matter

• (1) These Terms of Service ("ToS") govern the use of the Minecraft and Game hosting service ("Service") provided by CraftingHosting.
• (2) By registering and using the Service, you accept these ToS in full.
• (3) Crafting Hosting offers free and paid hosting plans. Due to the nature of a free service, availability and uptime of free servers cannot be guaranteed or predicted.

§2 Service Description

• (1) Crafting Hosting provides server hosting services with plan-specific resources.
• (2) The Service includes the use of a platform to create and manage servers via the Pterodactyl panel.
• (3) For free offerings, outages, interruptions, or technical limitations may occur and are outside of our guaranteed performance.

§3 Contractual Partner and Eligibility

• (1) Contractual partner is Lucas Wilms, Lüdenscheider Str. 21, 51688 Wipperfürth, Germany.
• (2) Use of the Service requires registration with accurate and complete information.
• (3) Users must be at least 16 years old. Users under 16 require parental or guardian consent.

§4 Registration and User Account

• (1) Registration is done via an online form on the website.
• (2) Users are obliged to keep their login data confidential and not disclose it to third parties.
• (3) In case of suspected unauthorized use of the account, CraftingHosting must be notified immediately.
• (4) CraftingHosting explicitly reserves the right to delete, block, or deactivate accounts at any time and without prior notice, especially in case of violations of these ToS or other reasons.
• (5) CraftingHosting is entitled to temporarily suspend accounts in case of ToS violations, abuse, or technical problems. Suspension may occur without prior notice. Reactivation happens after review by CraftingHosting or after the violation is resolved.

§5 Rights and Obligations of Use

• (1) Users receive a non-exclusive, non-transferable right to use the hosting service.
• (2) Use of the Service for illegal purposes or to distribute illegal content is prohibited.
• (3) Users commit not to take any actions that impair the infrastructure or other users (e.g., resource abuse, attacks).
• (4) Operating servers with copyrighted, offensive, or youth-endangering content is forbidden.

§6 Payments, Wallet Funds, and Right of Withdrawal

• (1) Paid Services: CraftingHosting offers premium hosting services and digital products. Prices, billing cycles, and conditions are explicitly stated during the checkout process.
• (2) Account Balance (Wallet): Funds deposited into the user's account balance (Top-Ups) are intended solely for the purchase of services within CraftingHosting. These deposited funds are strictly non-refundable, non-transferable, and cannot be paid out or transferred to a bank account under any circumstances.
• (3) Right of Withdrawal (Widerrufsrecht): By purchasing a digital product, hosting service, or depositing account funds, you explicitly agree that CraftingHosting will begin the execution of the contract immediately. You acknowledge that by consenting to immediate execution, you lose your legal right of withdrawal (Widerrufsrecht) once the service has been fully provisioned, the digital content has been delivered, or the wallet balance has been credited.
• (4) Failure to complete payments or fraudulent chargebacks will result in the immediate suspension of the associated account and servers.

§7 Availability and Changes to the Service

• (1) CraftingHosting strives for the best possible availability but does not guarantee it.
• (2) Outages, maintenance, or other interruptions may occur at any time without prior notice.
• (3) CraftingHosting reserves the right to change, limit, or discontinue the Service or individual features at any time without notice.

§8 Liability and Warranty

• (1) The Service is provided "as is" and "as available."
• (2) CraftingHosting is liable only for damages caused by gross negligence or intentional misconduct.
• (3) Liability for indirect damages, data loss, or lost profits is excluded.
• (4) Users are responsible for backing up their own data.

§9 Data Protection

• (1) Processing of personal data is carried out according to CraftingHosting’s valid Privacy Policy.
• (2) By registering, you agree to the collection, storage, and use of your personal data according to the Privacy Policy.

§10 Termination and Contract End

• (1) Users may delete their accounts at any time.
• (2) CraftingHosting may block or delete accounts at any time and without prior notice in case of ToS violations or abuse.
• (3) After contract termination, all related data will be irreversibly deleted unless legal retention obligations exist.

§11 Changes to the Terms

• (1) CraftingHosting reserves the right to amend these ToS.
• (2) Changes will be published on the website at least 14 days before taking effect.
• (3) If the user does not object within 14 days after notification, the changes are considered accepted.

§12 Final Provisions

• (1) Should any provision of these ToS be invalid, the validity of the remaining provisions remains unaffected.
• (2) German law applies excluding the UN Sales Convention (CISG).
• (3) The exclusive place of jurisdiction for all disputes arising from the contractual relationship is Wipperfürth, Germany.
